Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DictAll ("the App", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Subscription Terms

DictAll requires a paid subscription to access its features:

• Subscription Fee: $0.99 USD per month
• Auto-Renewal: Subscriptions automatically renew each month unless cancelled
• Cancellation: You may cancel anytime through your Apple ID subscription settings
• Refunds: Refund requests are handled by Apple according to their App Store policies
• Price Changes: We may change subscription pricing with advance notice

3. Bring Your Own API Key (BYOK)

DictAll operates on a "Bring Your Own Key" model:

• You must provide your own API key from OpenAI and/or ElevenLabs
• You are responsible for obtaining and maintaining valid API keys
• All API usage costs are charged directly by your chosen provider
• You must comply with your provider's terms of service and usage policies
• We do not have access to your API keys or usage data

4. Permitted Use

You agree to use DictAll only for lawful purposes. You may NOT:

• Use the App for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Share, transfer, or sublicense your subscription to others
• Attempt to bypass any security features or access restrictions
• Use the App to process content that violates third-party rights

5. Intellectual Property

DictAll and its original content, features, and functionality are owned by Pawel Gawliczek and are protected by international copyright, trademark, and other intellectual property laws.

Your transcribed content belongs to you. We do not claim any ownership or rights to text generated through your use of the App.

6. Disclaimer of Warranties

DictAll is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Transcriptions will be 100% accurate
• The App will be compatible with all systems or configurations
• Third-party API services will be available or perform as expected
• Any errors or defects will be corrected

7. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• API costs incurred through your usage of third-party services
• Transcription errors or inaccuracies
• Service interruptions or failures of third-party providers
• Any damages exceeding the amount you paid us in the past 12 months

8. Third-Party Services

DictAll integrates with third-party services (OpenAI, ElevenLabs) that have their own terms of service and privacy policies. Your use of these services is governed by your agreements with those providers. We are not responsible for the actions, content, or policies of any third-party services.

9. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate your use at any time by cancelling your subscription and uninstalling the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Warsaw, Poland.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
