Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SwiftSpeak ("the App", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Subscription Tiers

SwiftSpeak offers three subscription tiers:

Free Tier

• Basic transcription with limited daily usage
• One provider (OpenAI Whisper)
• Three formatting modes (Email, Formal, Casual)
• On-device AI (WhisperKit, Apple Translation)

Pro Tier - $6.99/month or $59.99/year or $99 lifetime

• Unlimited transcriptions
• 9+ AI providers
• Translation (25+ languages)
• Custom templates
• Cost analytics dashboard

Power Tier - $12.99/month or $99.99/year or $199 lifetime

• Everything in Pro
• Power Modes (AI workflows)
• Three-tier memory system
• Document RAG (knowledge base)
• Conversation contexts
• Webhooks integration

Subscription Terms

• Auto-Renewal: Monthly and annual subscriptions automatically renew unless cancelled
• Cancellation: Cancel anytime through your Apple ID subscription settings
• Refunds: Handled by Apple according to App Store policies
• Lifetime: One-time purchase with no recurring charges
• Price Changes: We may change subscription pricing with advance notice

3. Bring Your Own API Key (BYOK)

SwiftSpeak operates on a "Bring Your Own Key" model:

• You must provide your own API keys from supported providers
• You are responsible for obtaining and maintaining valid API keys
• All API usage costs are charged directly by your chosen providers
• You must comply with each provider's terms of service and usage policies
• We do not have access to your API keys or usage data

4. On-Device Processing

SwiftSpeak includes on-device AI capabilities that do not require API keys:

• WhisperKit: Free, on-device voice recognition
• Apple Intelligence: Free, requires iOS 18.5+ and compatible hardware
• Apple Translation: Free, requires downloaded language packs

On-device processing is included with all subscription tiers, including Free.

5. Permitted Use

You agree to use SwiftSpeak only for lawful purposes. You may NOT:

• Use the App for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Share, transfer, or sublicense your subscription to others
• Attempt to bypass any security features or access restrictions
• Use the App to process content that violates third-party rights
• Abuse Power Mode features for spam, harassment, or malicious purposes

6. Intellectual Property

SwiftSpeak and its original content, features, and functionality are owned by Pawel Gawliczek and are protected by international copyright, trademark, and other intellectual property laws.

Your transcribed content, custom templates, Power Modes, and documents belong to you. We do not claim any ownership or rights to content generated through your use of the App.

7. Disclaimer of Warranties

SwiftSpeak is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Transcriptions or translations will be 100% accurate
• AI-generated content will meet your specific needs
• The App will be compatible with all devices or configurations
• Third-party API services will be available or perform as expected
• On-device AI models will work on all supported devices

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• API costs incurred through your usage of third-party services
• Transcription, translation, or AI formatting errors
• Service interruptions from third-party providers
• Webhook failures or integration issues
• Any damages exceeding the amount you paid us in the past 12 months

9. Third-Party Services

SwiftSpeak integrates with third-party services (OpenAI, Anthropic, Google, DeepL, etc.) that have their own terms of service and privacy policies. Your use of these services is governed by your agreements with those providers.

Webhook integrations with services like Zapier, Make, or Slack are subject to those services' terms. We are not responsible for the actions, content, or policies of any third-party services.

10. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will cease immediately
• Your local data remains on your device until you delete it
• We will not refund any prepaid subscription fees

You may terminate your use at any time by cancelling your subscription and uninstalling the App.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Warsaw, Poland.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
